Blog#3b: Stand Your Ground: Post Your Research on this Law Here

Step Two of your Research Process is to identify specific issues about this law: the reason the law was put in place, how exactly the law is being used, whether it is a good or bad law, how it has replaced duty to retreat and why. . .  Post one RELIABLE source here: state what the source is, who the author is and summarize content of article or video.  Explain why/how this piece deepens, clarifies our understanding of this law.

  1. Anti-gun group study: In states with 'stand your ground' laws, justifiable homicide rates soar. by By Rene Stutzman, Orlando

"These laws can have deadly consequences, particularly for African-Americans,"

Every law has a flaw. This law should apply if you are provoking the threat or if the threat is not comforting you or anyone else you shouldn't have a right to use the law. This is what I believe is missing, but even if we did add that there is always racial profiling with in it. Ever since this law was applied to florida most homicides have skyrocketed as said within the article.

    1. Tamara--can you find articles that show homicides have risen with this law? Does the article above give statistics on African-Americans and consequences?

  2. Is the stand your ground law a good or bad law?
Many people claim that this law is bad. I feel like it has the potential to be a good law but some changes could be made. I feel like the law has back fired on the law makers because alot of people are able to walk free after comitting a crime because of this law.

"People have had the right to defend themselves from a threat as far back as English common law. The key in Florida and many other states was that they could not use deadly force if it was reasonably possible to retreat."
this website just sums up how the law is used some examples
I feel like there should be a part of the law that states if you are the vicim there should be just warning shos if anything just to be able to restrain the person to get away. Not to kill them thats unreasonable to me.There should be more limits

    1. Angelica--it sounds like this is an argument essay with a policy idea at the end which is fine! Start with exact definition of law as we looked at in class; then what was intent of law; then why bad; then your suggestions

I found out Stand your ground law is most likely to benefit African Americans, woman, and elderly than other groups. This video clarify's that not everyone can be saved by this law. Also you get to see other peoples opinions for example:

"Stand your ground is nothing more than the legal formulation of my unalienable right to protect my life, the lives of my family and my property."

"This is why progressives are now attacking it, just as they attacked the second amendment. There is no good to be found in the democrats' attack on the Constitution and our rights. To answer the question of "why?" would the left do this is simply to recognize the behavior of tyrants."

"Even though this law was irrelevant to what happened in Florida, the progressive subversives were ready to go with this agenda. Similarly, even though race also had no part in the death of Martin, the left was ready to exploit that." which is on the website.

  4. Is the Stand your ground law the reason why Zimmerman was found not-guilty?
    http://www.miamiherald.com/2013/07/16/3502481/juror-we-talked-stand-your-ground.html

"The Stand your ground law is a self-defense law that justifies a person of using (deadly) force against another when and to an extend that he/she reasonably believes that such conduct is necessary to defend himself or herself. It is a
NRA-drafted law that was passed by the Florida Legislature in 2005. That Later on was spread to more than two dozen states. "

This law made two major changes to homicides: it changed standard jury instructions and now the defendants have the right to immunity, which means they get a pre-trial Stand your ground. That is one of the reasons why Zimmerman's case made Stand your ground a national topic. Due to the immunity that he got, he was only arrested 44 days after shooting Trayvon Martin.

It is therefore said that Stand your ground led to the not-guilty verdict, however to which degree it did is unclear and in dispute. Besides, the jurors struggled with the law during this particular case because of the lack of evidence. Therefore the verdict was based on the head of the moment and stand your ground.

    1. Sarah--really precise legal info here--good to start with definition--your last paragraph is a little confusing but I see where you are going--is your plan to sift through the evidence and answer the question in your lead article above?

  5. the rights to bear arms a good or bad law?
    http://www.huffingtonpost.com/john-woods/gun-free-zones_b_2489815.html

the rights to bear arms is the second amendment so I think with it being a law people tend to take advantage of it. I think that this is a bad law. people these days carry guns with and without license because they think its okay and if they get caught they can fight for they rights and say they have the rights to carry it to defend themselves. if this law didn't existed I think trayvon and many other life's would of been saved.

there are a lot of people who believes that this law is good and bad. in a case I was reading this guy named john wood lost his girlfriend who was a victim in a school shooting. woods tells his reader that people believe that the more guns there are in places the less likely people will try to shoot because they have knowledge that the person they are trying to shoot will shot back. our president is trying to propose a new and improved ban on assault weapons. I don't think this law will ever be abolished because there are lots of people who belives this law is just.

    1. I think you might be confusing right to bear arms (which is in the constitution) with a newer law eg stand your ground! Let's discuss...you could write a broader argument essay on gun control...
